Terms and conditions

The short version: Yearless is not medical advice. Check with a doctor before you start exercising, stop if something hurts, and remember the camera can miscount. Premium is a one-time purchase. There is no subscription and nothing renews. Your records live on your phone, so keep your phone backed up.

1. Agreeing to these terms

These terms are an agreement between you and [Company legal name], [Company address] (“Yearless”, “we”, “us”). They cover the Yearless app and the yearless.app website. By using Yearless, you agree to them and to our Privacy Policy. If you don’t agree, don’t use Yearless.

2. Who can use Yearless

You must be at least 18, or the age of majority where you live if that is higher. Yearless has no accounts. The app and everything you record in it live on your phone, so anyone who can unlock your phone can open it. Keep your phone secure.

3. Health and safety

Yearless is a general fitness app. It is not a medical device and does not give medical advice.

• Talk to a doctor before you start a new exercise program, especially if you are pregnant, have a heart condition, high blood pressure, joint problems or an injury, or have not exercised in a long time.
• Stop straight away if you feel pain, dizziness, faintness or shortness of breath, and get medical help if you need it.
• Exercise in a safe space, clear of furniture and other hazards, and place your phone where it can’t fall on anyone.
• Fitness age is an estimate based on how you did in the test. It is not a medical measurement and says nothing definite about your health or life expectancy.
• The camera can miscount. Rep counts, clean and partial reps and test results can be wrong. You can check and correct counts before they are saved.
• Comparisons with other people your age are general estimates, not clinical norms.

You exercise at your own risk. You decide whether an exercise is right for you.

4. Your licence to use the app

We give you a personal, non-exclusive, non-transferable licence to use Yearless on devices you own or control, for your own non-commercial use, as long as you follow these terms.

5. Premium

• What’s free: one 60-second test, the fitness age test and your number, and sharing your results. Sharing is always free.
• What Premium includes: everything else in the app, including daily workouts, more 60-second tests, the 30-day challenge, retests, the full score breakdown, progress photos and the transformation reel.
• One payment. Premium is a one-time purchase through the Apple App Store or Google Play, charged to your Apple or Google account when you confirm it. It is not a subscription. It never renews and you are never charged again for it.
• What “lifetime” means. Premium stays unlocked for as long as we offer Yearless and the app runs on your phone. Features added to Premium later are included at no extra cost. We may change or improve features over time, but we won’t move features you’ve paid for behind a new payment.
• A new phone. Use Restore purchases in Settings, signed in to the same Apple or Google account you bought with. Premium works on your devices signed in to that account.
• Refunds are handled by Apple or Google under their policies. We can’t issue refunds for purchases made through them. If a purchase is refunded, Premium is switched off.
• Prices shown in the app may vary by country and may change for new buyers. A price change never affects a purchase you’ve already made.

6. Your content

Your workout data, progress photos and anything else you record in Yearless are yours. They are stored on your phone, and we don’t receive them.

Because we don’t hold a copy, we can’t recover your data if your phone is lost, broken or reset, or if you delete the app. Keep your phone’s backups switched on, and use Export my data in Settings if you want your own copy.

Share cards, rep clips and transformation reels you export carry the Yearless name. Once you share them, where they go is up to you.

7. Fair use

Don’t:

• Use Yearless for anything illegal, or take photos of other people without their permission or any content involving minors.
• Copy, modify, reverse engineer or resell the app, except where the law allows it.
• Try to get around the purchase or unlock Premium without paying for it.
• Use bots, scrapers or automated tools on Yearless or yearless.app.

8. Stopping

You can stop using Yearless at any time by deleting the app. That deletes the records stored in it, so export anything you want to keep first.

If we stop offering Yearless, we will give reasonable notice. The app doesn’t depend on our servers, so a copy already on your phone may keep working, but we can’t promise it will keep working with future versions of iOS or Android.

9. Our intellectual property

The Yearless app, name, logo, design, exercise content and software belong to us or our licensors. These terms don’t give you any rights to them beyond the licence in section 4.

10. Third-party services

Downloads, payments and phone backups rely on Apple and Google. The app also uses Google Analytics and Microsoft Clarity, as described in the Privacy Policy. Their terms apply to your use of their services, and we are not responsible for them.

11. Disclaimers

We work hard to make Yearless accurate and reliable, but it is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted, error-free, or that counts, scores or results will be accurate, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the extent the law allows, Yearless is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits. Our total liability for any claim relating to Yearless is limited to the greater of what you paid for Premium or US $50.

Nothing in these terms limits liability that can’t be limited by law, such as for death or personal injury caused by our negligence, or for fraud. If you are a consumer in a country that gives you rights these terms can’t take away, those rights still apply.

13. Indemnity

If you break these terms or the law and someone brings a claim against us because of it, you agree to cover the reasonable costs of that claim, to the extent the law allows.

14. Governing law and disputes

These terms are governed by the laws of [Governing law, e.g. State of Delaware, USA], without regard to conflict of law rules. Disputes go to the courts of [Courts location], unless the law where you live gives you the right to bring them in your local courts. Before starting a formal dispute, please email contact@yearless.app so we can try to sort it out.

15. Apple App Store

If you downloaded Yearless from the Apple App Store:

• These terms are between you and us, not Apple. Apple is not responsible for Yearless or its content.
• Apple has no obligation to provide maintenance or support for Yearless.
• If Yearless fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. Apple has no other warranty obligation.
• Apple is not responsible for claims relating to Yearless, including product liability claims, claims that it fails to meet legal requirements, consumer protection claims, or intellectual property claims.
• You confirm you are not in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. Changes to these terms

We may update these terms. We will change the date at the top, and for significant changes we will tell you in the app before they take effect. If you keep using Yearless after that, you accept the new terms. A change never takes away Premium you’ve already paid for.

17. General

If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term straight away, we haven’t given up the right to. You may not transfer these terms to anyone else; we may transfer them if Yearless is sold or reorganised. These terms and the Privacy Policy are the whole agreement between us about Yearless.
